By downloading, installing, or using the Rehearse Sales mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
The App is operated by Lee Nguyen ("we," "our," or "us").
Rehearse Sales is a mobile application that provides AI-powered sales roleplay training. Users can practice sales conversations with an artificial intelligence that simulates prospects and customers.
To use certain features of the App, you must create an account. You agree to:

The App uses artificial intelligence to generate responses during practice sessions. You acknowledge that:
The App is a training tool only. It does not provide professional sales consulting, business advice, legal advice, or financial advice. Always consult appropriate professionals for business decisions.
The App, including its design, features, content, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
You retain ownership of any content you create or input into the App. By using the App, you grant us a limited license to process your content solely to provide the service.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
The App relies on third-party services (Firebase, OpenAI, Anthropic, Fish Audio). We are not responsible for the availability, accuracy, or reliability of these services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
You may stop using the App and delete your account at any time.
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, fraudulent or illegal activity, non-payment of subscription fees, or extended periods of inactivity.
Upon termination, your right to use the App ceases immediately, we may delete your account data, and provisions that should survive termination will remain in effect.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App, updating the "Last Updated" date, and sending you an email notification (for significant changes).
Your continued use of the App after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Canada.
Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at rehearsesalesapp@gmail.com. We will attempt to resolve the dispute within 30 days.
